Matthew Buckland represented Privin Corporation Ltd in its Appeal in the First Tier Tax Tribunal against HMRC VAT assessments.

The Privin corporation was successful before the VAT tribunal, meaning that the claims for repayments of over £1million pounds are now due from HMRC.

As the judgement shows the tribunal  accepted the contentions of law and fact as advanced on behalf of Privin. The argument that the Company was a commodities trader and had taken proper steps to avoid being implicated in a fraud were accepted. The claims by HMRC that this was either fraudulent trading or that fraud was the only reasonable explanation for the trading were rejected.
