John Carl Townsend, instructed by Osborn Knight, successfully defends solicitor against High Court committal application brought by Esure Services Limited.

Esure, one of the UK’s largest insurance providers, had sought permission to bring committal proceedings for contempt against a solicitor. The solicitor involved had been a member of an internal investigations team at a large firm of solicitors. It was suggested by Esure that she and other members of the internal investigations team had conspired in the preparation of false witness statements to cover up their employer’s submissions of a fraudulent personal injury claim.
Rejecting Esure’s application, the Court found that a strong prima facie case had not been established, that the claim was disproportionate in any event and that it would not be in the public interest to grant permission.
Permission was, however, granted against the principle of the firm and another solicitor.
