CAREER HISTORY In the past two years, his practice has expanded and diversified to include Serious Fraud, War Crimes and Public Inquiries. He is presently instructed in the Baha Mousa Public Inquiry, chaired by Sir William Gage, an Inquiry due to last some 18 months and one whose ambit is both far-reaching and detailed. The Inquiries findings are expected to have a profound effect on the way the British Army operates in the theatre of war and during peacekeeping. He is the only Counsel to have appeared in all of the Iraqi abuse and war crime’s trials; including R v Cpl Larkin (Op Breadbasket), R v Pte Di-Gregorio, and R v LCpl Crowcroft (Op Salerno), the first British Soldier to face trial and be acquitted for alleged war crimes during Operation Telic 2. He has successfully defended in heavy fraud and cases involving Columbian “super grasses”, large-scale drug importations and Revenue and Customs cases. He has represented clients in cases in Belize, US, Cyprus, Germany, Iraq, Kuwait, Afghanistan and Africa. He was instructed in relation to the Serious Fraud Office investigation of Severn Trent Water Ltd, and as lead counsel in a fraud involving First Quench Retail, part of the Victoria Wine Group. He further represented the first of four defendants’ in an alleged fraud on One Railway Ltd, part of the National Express Group. This year he further represented one of the lead defendant’s in a multi million pound identity and mortgage fraud, involving the alleged systematic abuse of the “big four” banking groups and the setting up of shelf companies. The same defendant awaits a further money laundering trial later in the year. Hill Dickinson in (Operation Dwight) an alleged company fraud on the European Social Fund (ESF) and the European Regional Development Fund (ERDF) have recently instructed him. He has appeared in the Court of Appeal, the Divisional Court and the Courts Martial Appeal Court. He has appeared in appeals against conviction, sentence and judicial review.
SIGNIFICANT CASES
The Baha Mousa Public Inquiry. The Ministry Of Defence presently instructs Mr England. The Inquiry’s chair is Sir William Gage. The Inquiries terms of reference are detailed and far-reaching, and the hearings will last some 18 months. The Inquiries purposes are to investigate and report on the circumstances surrounding the death of Baha Mousa and the treatment of those detained with him.

R V M.Tunney & others. An alleged fraud on the European Social Fund and the European Regional Development Fund. Development and Research Initiatives, the defendant’s company, allegedly fraudulently received government funding on projects to disadvantage individuals and on new expanding businesses. Instructed by Hill Dickinson. R V K.Ukpabi & others. An alleged large- scale identity and mortgage fraud and money laundering case involving Eastern European and Nigerian nationals and the alleged setting up of “shelf” companies to divert funds.
R V M.Usman & others. Large- scale supply of Class A drugs involving a drugs supply ring in the North East of England. The case involves Police observations and undercover surveillance for over 6 months in London, Leeds, Bradford and Manchester.
R V P.Hewett & others. The alleged importation of some £20 million of Cocaine and other Class A drugs into the Uk, via Spain involving the use of multiple import/ export companies in Spain and the UK.
R V Fitzgibbon. Mr England has recently been instructed as Leading Counsel in the alleged murder of a 100-year-old mother by her son, due for trial at the Central Criminal Court in the summer of 2010.
OTHER CASES
R V Tyrone Downer. The trial at the CCC, involved the gangland killing of Yasin Abdirahman by a group of some 21 youths, members of the “MDP” and the “FDA”, two infamous gangs from the Windmill estate in West London. Mr England was acting as leading Counsel, whose client was found not guilty.
R V Mark Kirby. The trial involved some 16 defendant’s, a notorious alleged football violence case involving “hooligans” from Crystal Palace and Charlton Athletic football club. The trial Judge described the defendant’s behaviour as “sickening and violent thuggery”. Mr England’s client was the only one of the 16 to be cleared.
